By accessing and using NerdyScore ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this Service.

2. Description of Service

NerdyScore is a platform that allows users to track, value, and manage their video game collections. We provide tools for cataloging games, viewing market values, and managing personal collections.

3. User Accounts

Account Creation

To use certain features of our Service, you must register for an account. You must be at least 13 years old to create an account in compliance with COPPA (Children's Online Privacy Protection Act). If you are under the age of majority in your jurisdiction, you represent that you have your parent or guardian's permission to use the Service.

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

You may use our Service for lawful purposes only. You agree to use the Service in compliance with all applicable laws and regulations.

Prohibited Activities

5. Pricing and Valuation Data

Estimates Only

Prices, values, and metrics shown on the Service (including Loose, CIB, and New values, Nerdy Score, and rarity indicators) are estimates generated using our own methodology from publicly available third-party marketplace data, including completed and active listings on platforms such as eBay. They are provided for general informational and reference purposes only.

These figures are not appraisals, offers, or guarantees of the price at which any item can be bought or sold, and they do not constitute financial, investment, or purchasing advice. Actual market prices vary based on condition, completeness, region, timing, and buyer. You should independently verify any value before making a buying, selling, insurance, or other decision.

NerdyScore is an independent service and is not affiliated with, endorsed by, or sponsored by eBay or any other marketplace or data source referenced on the Service.

Use of Pricing Data

Our pricing and valuation data, together with the compilation, selection, and arrangement of that data, are proprietary to NerdyScore and are protected by applicable law. Subject to these Terms, you may access and use this data for your own personal, non-commercial reference.

Except with our prior written permission, you may not:

• scrape, crawl, harvest, or otherwise systematically collect pricing or valuation data from the Service, whether manually or by automated means;
• copy, reproduce, republish, sell, license, sublicense, or redistribute our pricing or valuation data, in whole or in part;
• use our pricing or valuation data to create, train, or populate any database, model, product, or service, including any product that competes with the Service; or
• remove, obscure, or alter any attribution or notice associated with the data.

We may suspend or revoke access and pursue any available remedy for unauthorized use of our pricing or valuation data.

6. User Content

Your Content

You retain ownership of any content you submit to the Service. By submitting content, you grant us a non-exclusive, royalty-free license to use and display your content solely as needed to operate and provide the Service to you.

Content Standards

All user content must:

• Be accurate and not misleading
• Comply with applicable laws and regulations
• Not infringe on any third-party rights
• Not contain harmful or malicious code

7. Privacy

Trademarks and Third-Party Rights

Game titles, cover and box art, screenshots, logos, publisher and developer names, and platform and console names displayed on the Service are the property of their respective owners and are used for identification and reference purposes only. NerdyScore does not claim ownership of these third-party marks or works.

NerdyScore is an independent service and is not affiliated with, endorsed, sponsored, or approved by any game publisher, developer, platform holder, or marketplace. Any reference to a third party or its products does not imply any such relationship.

9. Copyright Complaints (DMCA)

We respect the intellectual property rights of others and respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes a copyright that you own or control, please send a written notice to our designated agent at support@nerdyscore.com with the subject line "DMCA Notice" that includes:

• a description of the copyrighted work you claim has been infringed;
• the URL or location on the Service of the material you claim is infringing;
• your name, address, email address, and phone number;
• a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the owner; and
• your physical or electronic signature.

We may remove or disable access to material claimed to be infringing and may, in appropriate circumstances, terminate the accounts of repeat infringers. If you believe your content was removed in error, you may submit a counter-notice to the same address.

10. Disclaimers

Service Availability

We provide the Service "as is" and "as available," without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any data on the Service will be accurate or complete. Pricing and valuation disclaimers are described in Section 5.

11. Limitation of Liability

To the maximum extent permitted by law, in no event shall NerdyScore or its owners, affiliates, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your use of the Service.

To the maximum extent permitted by law, our total aggregate liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the total amount you paid us, if any, in the twelve months before the event giving rise to the claim, or (b) fifty U.S. dollars (US $50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to defend, indemnify, and hold harmless NerdyScore and its owners, affiliates, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or connected with (a) your use of the Service, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

13. Termination

Your Right to Terminate

You may delete your account and stop using the Service at any time. Upon account deletion, your personal information will be removed in accordance with our Privacy Policy.

Our Right to Terminate

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms of Service or engage in conduct that we deem harmful to other users or the Service.

14. Governing Law and Disputes

These Terms are governed by and interpreted in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. You agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.

15. General

These Terms constitute the entire agreement between you and NerdyScore regarding the Service and supersede any prior agreements. If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full effect. Our failure to enforce any provision of these Terms will not be a waiver of that provision. You may not assign or transfer these Terms without our prior written consent; we may assign these Terms without restriction.

16. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
